DMCA Policy
pinereel respects the intellectual property rights of creators and copyright holders. This policy outlines how we handle copyright infringement claims under the Digital Millennium Copyright Act (DMCA).
Reporting Copyright Infringement
If you believe that content on pinereel infringes your copyright, you may submit a DMCA takedown notice. To be effective, your notice must include all of the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed (e.g., a link to the original work)
- Identification of the infringing material on pinereel, including a direct link to the content and enough information to locate it
- Your contact information, including full name, mailing address, telephone number, and email address
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
How to Submit a Notice
DMCA takedown notices can be submitted through the following channels:
- Use the "Report" button on any video page and select "Copyright" as the reason. Include your full DMCA notice details in the description field.
- Email your complete DMCA notice to our designated agent at support@pinereel.com.
Incomplete notices may not be processed. We will make reasonable efforts to contact you if your notice is incomplete.
What Happens After a Notice
- Upon receiving a valid DMCA takedown notice, pinereel will promptly remove or disable access to the allegedly infringing content.
- We will notify the uploader (the alleged infringer) that their content has been removed and provide them with a copy of the takedown notice.
- The removed content will remain inaccessible while the claim is pending. Existing buyers will lose access to the content during this period.
- If the content is permanently removed, existing buyers' access grants for that content will no longer be fulfillable. pinereel is not responsible for refunds in these cases, as payments are settled instantly on-chain.
Counter-Notification
If you are a creator whose content was removed and you believe the takedown was issued in error, you may submit a counter-notification. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original takedown notice
Upon receiving a valid counter-notification, pinereel will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, pinereel may restore the removed content.
Repeat Infringer Policy
pinereel maintains a policy for terminating accounts of repeat infringers in appropriate circumstances. Our repeat infringer policy works as follows:
- First valid DMCA notice: Content is removed and the creator receives a warning.
- Second valid DMCA notice: Content is removed, the creator receives a second warning, and their ability to upload may be temporarily restricted.
- Third valid DMCA notice: The creator's account may be permanently terminated at pinereel's discretion.
- Egregious or willful infringement may result in immediate account termination regardless of prior history.
Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages, including costs and attorney fees. Do not file a DMCA notice or counter-notice unless you are the copyright holder (or authorized to act on their behalf) and you have a good faith belief in the accuracy of your claim.
Designated Agent
pinereel's designated DMCA agent for receiving takedown notices can be reached at support@pinereel.com or through the platform's report system using the "Copyright" reason category.
Limitations
pinereel processes payments instantly via the Solana blockchain. Because blockchain transactions are irreversible, pinereel cannot issue refunds for content removed due to DMCA claims after the transaction has been confirmed. Buyers are encouraged to report suspected infringing content before purchasing if they have concerns about a video's legitimacy.
